5. Data Retention Personal data is stored only as long as necessary to fulfill the coaching purpose or to meet legal retention requirements. Once these periods expire, data is securely deleted or anonymized.

 

6. Your Rights You have the right at any time to:

• Request the deletion of your data (provided there are no legal obligations to the contrary).

General Terms and Conditions (GTC)

 

1. Scope These GTC govern the conclusion, content, and execution of contracts between Andreas Schwarz – Bewusstseinsarchitekt (hereinafter "Provider") and clients (hereinafter "Client") regarding coaching services (individual and group coaching, workshops, online formats). Deviating conditions of the Client shall only apply if confirmed by the Provider in writing.

 

2. Services The Provider offers coaching services for personal and professional development. Coaching is not therapy, nor is it legal, tax, or financial advice, and it does not replace such services. The scope, dates, duration, and fees are defined in the respective offer, order confirmation, or booked package.

 

3. Conclusion of Contract The contract is established via written confirmation (including email) of an offer or through a booking on the Provider’s online platform. The Provider may refuse bookings without providing reasons.

 

4. Prices and Payment Terms Prices are stated in CHF. Unless otherwise agreed, invoices are due before the scheduled appointment. In the event of non-payment, the appointment will be canceled and the full price will be invoiced. For late payments, interest of 10% per month and a reminder fee of CHF 20 per reminder may apply starting 15 days after the invoice date.

 

5. Cancellation, Rescheduling, and No-Shows

• Individual Coaching:

  • Up to 48 hours before the appointment: Free of charge.

  • Less than 48 hours before: 50% of the fee.

  • No-show without notice: 100% of the fee.

• Programs/Workshops:

  • Up to 14 days before start: Free of charge.

  • Later: 50–100% of the price depending on the notice period.

6. Changes and Cancellations by Provider The Provider may postpone or cancel appointments for important reasons (e.g., illness, force majeure). Fees already paid will be refunded or credited toward a future date.

 

7. Client Obligations The Client agrees to provide truthful information and participate actively. Coaching requires the Client’s personal responsibility. It is not a substitute for medical or psychotherapeutic treatment.

 

8. Intellectual Property All materials, concepts, and documents provided are protected by copyright. The Client receives a non-transferable right to use these materials for personal use only. Commercial use or distribution requires written consent.

 

9. Liability The Provider is liable for intent and gross negligence. Liability for slight negligence is limited to the breach of essential contractual obligations. No guarantee of success is provided, as results depend on the Client’s own implementation and commitment.

 

10. Governing Law and Jurisdiction Swiss law applies exclusively. The place of jurisdiction is Binningen, Switzerland.
